Re: Information to customers and suppliers issued by Relevi S.p.A. according to article 13 of Italian Legislative Decree no. 196/2003

Whereas

  • through the establishment of our business relationship and during the latter, our company will have to gather and process your personal data.
  • for the sake of clarity, we hereby explain the following definitions as per Italian Legislative Decree no. 196/2003:
    Data processing shall mean any operation, or set of operations, carried out with or without the help of electronic or automated means, concerning the collection, recording, organization, keeping, interrogation, elaboration, modification, selection, retrieval, comparison, utilization, interconnection, blocking, communication, dissemination, erasure and destruction of data;
    Personal data shall mean any information relating to natural or legal persons, associations or corporations that are or can be identified, even indirectly, by reference to any other information including a personal identification number.
That being stated,
according to article13 of Italian Legislative Decree no. 196/2003 (Privacy Code),

we hereby inform you

that both the gathering and processing of your personal data will be carried out by our company as follows:
  • purpose: your data will be processed in order to ensure a proper task fulfilment in terms of book-keeping, business, fiscal & technical aspects, as well as of all company's activities regarding our business relationship;
  • advertising purposes: after obtaining your prior and explicit consent, your data can also be used to send advertising material/communications by post, e mail, telefax, sms and similar means of communication; after providing us with your consent, you are anyway entitled to object, with no charge and at any time, to processing of your data for the following purposes:
  • processing: your data will be processed with the help of paper, computer or electronic means according to the law, to principles of lawfulness, fairness and protection of your privacy;
  • voluntary data supply: it is not compulsory to supply data, the latter shall be provided on a voluntary basis;
  • consequences of possible refusal: a possible refusal to supply data or a total objection to data processing may result in our being unable to continue any relationship with your company; on the contrary, a possible refusal to utilize your data for sending material/advertising communications will have no consequences for any existing or future relationships;
  • subjects or categories your data can be communicated to: subjects such as controlled, controlling and/or related companies, lawyers, public accountants, employment consultants, banking firms, debt collection companies, factoring companies, agents and representatives, professional associations, etc. our company avails itself of. Under no circumstances your data will be disclosed;
  • persons in charge of the processing: your data will solely be processed by the persons in charge of both our administrative and trade departments;
  • data subject's rights: the data subject is entitled to any rights as provided for by article 7 whose unabridged text is enclosed with this information and shall be considered as integral part of the latter;
  • data controller: Relevi S.p.A. having its registered office in Rodigo (MANTOVA), via Postumia N° 1, in the person of its pro tempore legal representative;
  • person in charge of response to data subject: Mr MARCO SALMASO: any enquiries or requests for explanations can be transmitted to the latter. A comprehensive and constantly updated list of the relevant persons in charge of data processing is available on our internet site and/or as hard copy in our head office.
This information can be completed, either verbally or in writing, by inserting additional elements and indications, in order to meet any possible cognitive needs in terms of privacy, as well as to comply with law.
Article 7 of Italian Legislative Decree no. 196/2003 (Right to access personal data and other rights).

  • A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.
  • A data subject shall have the right to be informed about: a) the source of the personal data; b) the purposes and methods of the processing; c) the logic applied to the processing, if the latter is carried out with the help of electronic means; d) the identification data concerning data controller, data processors and the representative designated as per Section 5(2); e) the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
  • A data subject shall have the right to obtain: a) updating, rectification or, where interested therein, integration of the data; b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed; c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
  • A data subject shall have the right to object, in whole or in part: a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection; b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
